8. Limitation of Liability

To the fullest extent permitted by applicable law, Risebouw and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising out of or related to your use or inability to use the Site or Services, even if we have been advised of the possibility of such damages. Our total liability to you for any direct damages shall not exceed EUR 100 or, if greater, the amount you have paid to us (if any) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms or applicable law. Sections 5–12 will survive termination.

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Netherlands, without regard to conflict-of-law provisions. The competent courts of the Netherlands shall have exclusive jurisdiction, except where mandatory consumer-protection laws provide otherwise.

If you are a consumer residing in the European Union, you may also access the EU online dispute-resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We do not commit to using any alternative-dispute-resolution entity unless required by law.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms (together with any documents referenced herein, including our Privacy Policy) constitute the entire agreement between you and Risebouw regarding your use of the Site and supersede all prior agreements, understandings, or representations.
